Last Will and Testament

A valid legally enforceable Last Will and Testament (“Will”) is your opportunity to ensure that your intentions regarding who will receive your assets upon your death will be followed. Some people make the mistake of thinking that they can prepare, sign and notarize a statement explaining who they want to inherit their property. There is a very real risk that the Surrogate’s Court will ignore their document, since it may not satisfy New York statutory requirements, in order to be valid and enforceable Last Will and Testament. if that occurs, your assets will be distributed in accordance with the New York laws of intestacy, which apply to a New York resident dies without a Will.

Living Will and Health Care Proxy

A Living Will and Health Care Proxy can state your desires regarding whether or not to keep you alive on a respirator if there is no chance of recovery, whether you should spend your last days at home or in a hospital, etc. The Health Care Proxy enables you to designate a trusted friend or relative to make health care decisions for you, if you are mentally or physically unable to make or express those opinions.

Power of Attorney

A Power of Attorney may be used in order to complete the purchase or sale of real estate if you will be traveling out of the country or otherwise unavailable when the closing of title occurs. A Power of Attorney may also be used in other instances in order to grant authority to your designated representative to sign legal documents on your behalf or collect or pay money on your behalf.

Since the Power of Attorney is a very powerful and potentially dangerous document, its scope can be limited. We recommend that your Power of Attorney be carefully prepared to insure that it only grants the authority that you intend to convey, and that it is effective for only the intended period of time or the particular transaction. Estate Probate or Administration

Our New York Probate lawyer represents estates in estate probate or estate administration. This is the process of obtaining a Surrogate’s Court decree granting authority to the estate executor or estate administrator to administer the assets of the decedent’s estate. The Surrogate’s Court decree enables the estate executor or estate administrator to marshall the decedent’s assets and distribute the assets to the decedent’s beneficiaries designated in the decedent’s Will, or by the laws of intestacy if the decedent did not leave a valid Will. If the Surrogate’s Court decree contains restrictions on the authority granted to the estate executor or estate administrator, our New York Probate lawyer will need to apply to the Surrogate’s Court for an order removing the restrictions. This often occurs where the estate includes real estate.
